Offer
Maksym Arturovych Lanskoi, an individual entrepreneur (hereinafter referred to as the "Executor"), registered and operating in accordance with the legislation of Ukraine, guided by Articles 633, 641 of the Civil Code of Ukraine, offers to an unlimited number of individuals to conclude this Agreement on the provision of services (hereinafter — "Agreement") on the following conditions:
1. TERMS AND GENERAL PROVISIONS.
1.1. Services - a set of services provided by the Contractor in the order and under the conditions defined by this Agreement, which are an integral part of this Agreement.
1.2. An offer is an offer of the Contractor (presented on the Contractor's Website), addressed to an unlimited number of natural persons in accordance with the legislation of Ukraine, to conclude this Agreement under certain conditions.
1.3. The Artist's website is a web page on the Internet at the address https://orion-nebula.space, which is the official source of information for Users about the Artist and the services provided to them.
1.4. Acceptance is full, unconditional and unconditional acceptance by the User of the terms of the Public Offer of this Agreement.
1.5. The User is a natural person who has accepted the Public Offer of the Performer, set forth in this Agreement, and registered in the Telegram bot @OrionNebulaBot.
1.6. The parties are the Artist and the User.
1.7. Orion Nebula is a multiplayer chat game in the Telegram messenger.
1.8. Device — means an electronic computing machine (computer) and/or other device functioning on the principle of a computer, capable of processing and reproducing sound and images, both stationary and portable (including, but not limited to: mobile phones, smartphones, PDAs , etc.), which has the ability to access the global Internet network.
1.9. In-game currency is a virtual currency in Orion Nebula called "nanites".
1.10. Rules are in-game rules prescribed by link.
2. SUBJECT OF THE AGREEMENT.
2.1 The contractor undertakes to provide access to the Orion Nebula service in case of non-violation rules to the user.
2.2 The user has the right to voluntarily donate any amount to the performer and receive in-game currency in return.
3. TERMS OF PROVISION OF SERVICES.
3.1. The service is provided in the form of access to the Orion Nebula service in the Telegram messenger.
3.2. Registration in the Orion Nebula service is considered acceptance of this Agreement, which means full and unconditional acceptance by the User of the terms of this Agreement and is equivalent to the User's signature under the Agreement.
3.3. From the moment of registration in the Orion Nebula service, this offer is considered accepted, and the contract is concluded.
4. RIGHTS AND OBLIGATIONS OF THE EXECUTIVE.
4.1. The executor has the right to:
4.1.1. They will receive from the User the information necessary for the provision of services under this Agreement.
4.1.2. Provide access to the Orion Nebula service to the user.
4.1.3. Close access to the server during technical work related to updates or elimination of errors in the program code.
4.1.4. Close access to the Orion Nebula service in the event of a breach rules.
5. RIGHTS AND OBLIGATIONS OF THE USER.
5.1. The user has the right to:
5.1.1. Access the Orion Nebula service.
5.1.2. Donate money to the Artist for the development of the Orion Nebula service.
5.2. THE USER SHALL:
5.2.1. Follow rules of the Orion Nebula service.
COST OF SERVICES AND PAYMENT PROCEDURE.
6.1. The cost of the Orion Nebula service is indicated in the chat game under the link /donations.
6.2. The cost of the Services stipulated in this Agreement is paid by the User in non-cash form, by paying the invoice, the link to which is provided by the Orion Nebula service.
6.3 In-game currency is credited to the account within 24 hours after payment, but on average no more than 10 minutes.
6.4. The purchase of nanites is considered a voluntary donation in favor of the Orion Nebula service, aimed at covering the costs of the project for various needs: payment for hosting, servers, domain names, advertising services, and so on. Donations are non-refundable under any circumstances.
7. RESPONSIBILITY OF THE PARTIES.
7.1. The parties are responsible for non-fulfillment or improper fulfillment of obligations under this contract in accordance with the current legislation of Ukraine.
7.2. To the maximum extent permitted by the legislation of Ukraine, the Contractor is not responsible for indirect, collateral, actual, indirect or direct losses, direct or indirect lost profits or loss of income, loss of data, operational qualities, goodwill or other intangible values, related to a) the User's access to Services and their use, or the impossibility of such access or use; b) with materials or conduct, including defamatory, offensive or illegal, of any third party; or c) with unauthorized access, use or modification of the User's materials or information. Under no circumstances shall the aggregate liability for all claims relating to the Services exceed the greater of the following two amounts: one United States dollar ($1).
7.3. The user agrees that the disclaimer of guarantees and limitations of liability set forth in these conditions reflect a reasonable and fair distribution of risks, and are also a necessary condition for the provision of services by the Contractor for an affordable fee.
7.7. In case of violation by the User rules, the Contractor has the right to unilaterally terminate this Agreement, to block the user's access to the Orion Nebula service.
8. VALIDITY PERIOD OF THE OFFER.
8.1. This Public Offer enters into force from the moment of its posting on the Contractor's Website and is valid until the moment of its withdrawal by the Contractor.
8.2. The Contractor may at any time make changes to the conditions of the Offer and/or withdraw the Offer at any time at his discretion. If the Contractor makes changes to the Offer, such changes shall enter into force from the moment the amended text of the Offer is posted on the Contractor's Website, unless a different date for the entry into force of the changes is specified directly in the text of the amended Offer.
